Unwed mothers legal rights

My partner and i live together and are separating. We have a toddler. Who has legal guardianship?

Usually the individual that the child lives with for the majority of the time.

Until decided differently by a court, you both have equal legal rights even if child lives with you.

Once you separate, you could petition fam court for sole custody if in child's best interest.
