Legal Question in Family Law in New York

Upcoming first appearance - what's it mean?

My notice giving me a court date says HEARING: 15 MIN; initial appearance. It also says I'm required to attend. Does this mean that an additional appearance will be required by me on a future date? I live over 1600 miles away and this would be a serious hardship.

Re: Upcoming first appearance - what's it mean?

An initial appearance is the first date on which a Petition is heard in Family Court. Although a trial is not conducted on that day and no final decision will be rendered, a temporary order can be issued. A temporary order can affect your rights and impact the future path of your case. If you live 1600 miles away, I would suggest that you retain counsel to appear in court on your behalf. Let me know what county your case is in and let us know if you need any further assistance.

Yes. The Family Court is analogous to a meat grinder. Suggest you retain experienced counsel who knows how to settle a case.

Perhaps then you would not have to appear at all.

The is a form on the court's website that, if filed in advance and approved, will allow oyu to appear via telephone. It also may be wise to retain to counsel to appear, in person, for you.
