Legal Question in Family Law in New York

visitation

I had a baby six years ago..the biological father denied the child and moved out of state...when the child was 16 months old I dated a man whom I married and has provided for the child as if she were his own...financially and emotionally. She knows him as daddy and does not yet know of her biological father. Now six years later...the biological father has contacted a mutual friend and told her he wants to be part of my childs life. I don't think this is fair to me my husband or my child. My husband want's to adopt my child. What can I do? I don't think my child is emotionaly mature enough to handle something like this.

Re: visitation

You state a reasonable case and may be able to pursue the adoption without the bio father's consent because of his absence. He may, however, commence a proceeding to establish paternity and get access; you may contest on the basis that he neglected/aboandoned the child. You should consult with a lawyer right away. These are tricky situations and surprising results frequently occur.
