Legal Question in Family Law in New York
Visitation what can I do?
I want my child's father to visit the child whenever he wishes, including days and times. I am the custodial parent, every since he abandoned the home, I've been flexible with allowing him to see our one year old. Now, he summoned me to family court. He now wants to take the child out. I don't agree. What can I do? My reasons? he's been arrested (a suicide suspect), he home address is unknown, he suffers from depression and his mother believes in corporal punishment(discipline measures) Eventhough my son is a little hyperactive, I don't believe in spanking and she always requests that I should. I am concerned of what might happen to the baby when I'm not around. I am willing to allow the father to take him out once the child is five to six years old. By this time the child will be able to talk and express his concerns or what has happened to him. Please help me, a desperate mom is writing.
Thank you

Answer the petition and appear in Family Court, give your reasoning and rationale to the judge.
