Legal Question in Family Law in New York

visitation

My ex-wife and I have joint custody of our 13 yr. old daughter.My daughter lives with her mother and and I had very generous visitation.every other weekend,basically any time i wanted her to come over it was permitted.

We are bolth re marriedMy wife and ex had an arguement over payment of certian things(braces for the child) Now my ex wife will only allow me to visit with my daughter by my self and not have her stay over with my new wife in the house.''I can visit anytime or day as long as my wife is not there'' are my rights as a father being violated?

Absolutely! She has no right to use the child as punishment for your wife and her having a disagreement...which is what she is doing. Do not allow it!

Tell her you will continue to visit with your daughter as you have and if she stops you...go to Family Court!

Sounds like she would like to drive a wedge between you and your wife. You need to assert your rights.
