Legal Question in Family Law in New York

visitation rights

What is the responsiblity of the father in visitation rights, when the children live with him and his ex-wife has moved out-of-state? Does he have to take the children to and from the airport for visiting their mother? Is he responsible for the financial expense of taking them to meet the plane or their mother?

Thank you!!

Re: visitation rights

Ordinarily, the Court expects that the Non Custodial parent will bear the costs of arranging and paying for visitation with their child/ren.

However, a parent's responsibility to his/her children is to nuture, protect, assist them in developing into responsible, loving, well adjusted people; by using any and all resources that may be available to them, in meeting the children's needs.

So,... if you have the resources, in time and money, and the mother does not, and the children want to see her; and the mother is not a "bad person" for the children to be around, then do what's necessary, and give yourself a break from the kids. It can be a good thing.

Good luck,
