Legal Question in Family Law in New York

Visitation rights to 20 year old supported son

I have a son who is 20 and in college. I am paying child support and half of college. He does not return calls or e-mails for over a year. Furthermore, his Mother says too bad! Is he too old to try to get a visitation order? Should I try to reduce support or college to force this issue a bit?

Re: Visitation rights to 20 year old supported son

As a person over the age of 18, he has the right to refuse to see anyone he does not wish to see. An attempt to enforce a child visitation order will prove futile.

As for child support, you are not going to get a reduction of child support based upon your son's failure to keep in touch with you and if you are paying his college expenses based upon an order of the court or from a divorce settlement, you can not reduce his support. If this is not based upon those things, you may be able to reduce or get a reduction but you should consult an attorney to see if you can.
