Legal Question in Family Law in New York

visitation

I have sole custody of my children and there father gets to visit every other sunday and on the sunday he cant monday or friday. He never picked them up for a monday or friday and we have a court order that he has to bring them back at 7:00 everytime.He is always late andi'am scared he will kidnapp my children he breaking the court order what right do i have?

Some people were just born 5 minutes late. No court can change that. If you have evidence that he is planning on contacting the children, suggest you report same to the police and call your attorney.

Some people were just born 5 minutes late. No court can change that. If you have evidence that he is planning on KIDNAPPING the children, or that he has threatened to do so, suggest you report same to the police and call your attorney.

You do not mention how late he is in returning the children. If you believe the problem is serious [and harmful to the children], you can peitition the Family Court to modify the visitation.
