Legal Question in Family Law in New York

Visitations

My x abaondoned my son and i last year, and now a year later he is remarried and suing for visitations. He goes 3 or 4 months at a time without seeing him and really doesnt care about my son. How can i win in court? Will the law automatically give hime rights just cause he biologically the father? can he be forced to give up paternal rights?

Re: Visitations

It is unlikely the Court will deny your child's father the right to visitation, or "force" relinquishment of his parental rights.

The father's [non] relationship with you, nor his delayed request for a visitation order, has little if anything to do with your CHILD'S RIGHT to have the Court order visitation and support, from his father.

Good luck,
