Legal Question in Family Law in New York

voluntary surrender of rights

If I voluntarily give up my rights as a parent, do I still have to pay child support for that child? I was never married to the other parent who has custody.

Re: voluntary surrender of rights

That depends on what you mean by giving up all parental rights.

Giving up parental rights for your child to be legally adopted will relieve you of parental obligations of support.

Agreeing to not request visitation, contact or access to the child, without more will not relieve you of parental obligations of support....

Though the mother may, elect or stipulate, not to demand child support, to avoid having the father's presence in her and her child's life, the custodial parent can Petition the Court, to resume Child support obligations, up to the childre reaching age of 21 (in NY; other States 18).

GOOD LUCK.
