Voluntary Termination of Paternal Rights

My ex and I went to court about child support for our 5 children. He lived in TX, I in NY. I was remarried and my ex terminated his parental rights and my husband was going to adopt my children, so my ex got to stop paying child support. Some yrs. later my husband has still not adopted my children and is not going to. Can I go back and get support from the childrens father?

Yes. Since there has not been an adoption, the natural father is still on the hook.

I don't believe that he would be responsible for child support in the past. If you file right now in New York Family Court, he would be responsbile from the date of filing.
