Legal Question in Family Law in New York
Wanting a Divorce But Spouse Not Cooperating
My friend is going through some tough times. She left her husband in Asia and came back here last year with their son but she can't get seem to get him to give her a divorce. He so angry and bitter about her leaving that he's threatening to disappear and never give her a divorce. Every time she tries to contact him, he yells at her. Her lawyer advised her to be nice to him or she'll never get him to give her a divorce. All she wants from him is for him to provide for their son's education, and for them to divorce so she could move on with her life. What is she to do? She obviously had given up her job and moved out to Asia with him. They've been married for I think over 6 years. They were also married in Asia so she doesn't even have a marriage license. What is she to do? She's miserable. She just want to move on.

Re: Wanting a Divorce But Spouse Not Cooperating
Your friend has my sympathies. Divorce is always very difficult and the cultural problems attendant upon the patriarical oriented Chinese
community intensifies these issues. She can get a divorce even though he is in China. It just requires some extra paperwork. No American court will be able to get her effective child support, but the divorce is no problem.
