Legal Question in Family Law in New York

my ex wife has "cleaned out" my 15 year old daughter's 529 college savings account. I have contributed approximately 12,000 dollars over a ten year period (that is the principle plus there would be accrued interest as well). What recourse do I have and is my ex wife criminally liable

No she is not criminally liable but you can file for a child support modification where she must contribute for your child's college education.
