my wife and i are getting a devorce she lives in texas i live in new york dont we have to file in new york
and do i have to give her a devorce

The petitioner (the person requesting a divorce) may file in their home state with or without the respondent's permission. The respondent may object to the petitioner; however, after a the exchange of pleadings the divorce may be granted.

if you are the one filing for a divorce you can file in NY.
If your wife is the one filing for the divorce she can file in Texas.
If you do not want to have the action heard by the courts in Texas i suggest that you file in NY first.
If you were married in NY and file first, you have a good chance of having the matter resolved in NY.
