Legal Question in Family Law in New York
My wife is divorcing me. Things are starting to get ugly. She wants me to pay the mortgage on the house ($2400.00 month) and also get out. I cant afford both, but I'd rather stay here. I run a small business out of the house plus my day job. I have a history of drug abuse and I realize this is against me. I had a stent put in my heart two weeks ago and Ive missed a few days of work. My wife finds this unacceptable, and has been flipping out on me if I loose a days pay. (I've never missed a mortgage payment in 30years)
She is not a stable individual. She plans on going to the police and telling them that I tried to kill her and now sleeps w/ a knife under her pillow. This way she can get an order of protection and finally be rid of me. my question is: Can she simply tell the police I tried to kill her and have me put out?
I'm not sure if this matters, but the house is on the market to be sold. My wife doesn't make nearly enough to pay the mortgage, so she needs my contribution. Six years ago, we re-mortgaged the house, my credit was not so good so I put the house entirely in her name.
