Legal Question in Family Law in New York

Is Why Wife Entitled to My Pension

I have been married for 7yrs, and my wife left me. Is she entitled to alimony, spousal support or any part of my pension? What is the maximum number of years to be married in order for a spouse to collect the others' pension or property?

Re: Is Why Wife Entitled to My Pension

On the pension/property piece of your question, if any portion of the property or pension was acquired or increased in value during the marriage, then there is a substantial probability that the portion that increased or was acquired during the marriage would be split, in the process known as equitable distribution.

Whether she would qualify for spousal support - which is the same as alimony - isn't a function of years or who left whom. It's a decision made by the judge based on the specifics of the situation.
