Legal Question in Family Law in New York

My wife left me while I am at war

What do I need to do to protect myself and my daughter from my wife. She left me while I am currently at war and is running up my credit cards. I have blocked all access to my credit and accounts. I want to have my daughter back when I return from Iraq. I am stationed in Germany where my wife and daughter were living with me. She is now living in NY. I don't know what I should do to prepare for my return.

Re: My wife left me while I am at war

First, talk to the legal assistance officer from the JAG detachment nearest to you; if there is not one at your FOB, ask the paralegal NCO when one will come out to your area.

Second, be prepared to meet your support obligations under AR 608-99 (if you are Army - similar Regs exist for other beanches).

Third, if you have given a Power of Attorney, you should revoke it. Fill out a revocation at your JAG office and contact the County Sheriff (in whatever county in NY she resides in) to have it SERVED on her (keep the proof of service)... send copies of the revocation to the bank(s) and credit card companies as well.

Fourth, get an attorney. Talk to your JAG officer to determine which jurisdiction will control your divorce and custody issues - work with them to find counsel there.

Airborne!
