Legal Question in Family Law in New York
My wife and I were legally separated five years ago. In 2010 we attempted a reconciliation and have been living together until about one month ago. It is likely that we will proceed with a divorce eventually. We never followed through with any of the separation/divorce process. My question is: Are we still legally separated or does the fact that we have been living together for five years negate the separation?

Unless the Order of Separation was vacated by a court, you are legally separated.
