Legal Question in Family Law in New York

my wife and i live in NYS. Her parents live in WA where we were married after I completed my 5 years in the navy. We moved to my hometown in syracuse NY. We bought a house and had a child a few years later. My marriage is on its way out and my wife thinks she can take my daughter out of state across the country weather i like it or not. My wife lost her drivers liscense due to a DUI and she has been stealing my pain medication. Due to her addiction and job loss I cant afford a lawyer as of yet. I have a great job now so I will have the money in a few months but what are my rights in the mean time. I'm afraid she will win because she is the mother.

You can go to the family court and file for custody. You should ask that the court issue an order prohibiting either of the parties from relocating with the child from Onondaga County.
