Wife moved out of marital home

Wife moved out of marital home and pulled paycheck fron direct deposit of joint bank account, refuses to pay for any bills such as car or rent, how long do i have to wait before I can leave the residence. She left belongings and has left me no forwarding address or contact number. Also, can she come back and try to take the cars and other belongings that need to be paid for, after I continued to pay for them?

Re: Wife moved out of marital home

You can leave the residence whenever you want. However, you may incur liabilities, such as owing rent for the balance remaining on the lease, in doing so. Your wife may or may not have to share those costs, depending on a number of factors. All marital property will be subject to equitable distribution, regardless of who paid for them or whose name is on title; however, one of the factors to be considered is each spouse's contributions to the value of the assets. feel free to call our office to discuss this further.

You may need an order of the court to get your wife to contribute to the joint marital expense. Please call me to discuss this matter.
