Legal Question in Family Law in New York

Wife wants to ''undo'' divorce

My wife and I got divorced almost 2 years ago. It was in NY state - and under the cruel and inhumane ground- I had started dating someone else during the divorce process and we had a baby 4 months after the divorce was final. Now my ex is saying that our divorce isn't vaild because of my adultery. Does she have any legal ground?

Re: Wife wants to ''undo'' divorce

very simply stated - no.

Actually once the summons is served, technically, but not legally, you are free to do whatever you want to do.

She can threaten all she wants, but you are divorced.

No. Your only possible worry is as to whether a proper Notice of Entry was served and filed.

Re: Wife wants to ''undo'' divorce

Getting legal advice from a spouse you are divorcing is never a good idea. Getting legal advice from a former spouse is even worse.

Once you are divorced, you are divorced.
