Legal Question in Family Law in New York

I was wondering if because the non custodial parent has no rights, and the paternity test hasn't come back yet, if i'm able to leave the country with my daughter.

You can leave the country, but if you have a current case pending, you must still make yourself available to the court for further proceedings.
