Legal Question in Family Law in New York
I am writing as I believe my sister needs a lawyer. She has not been with her husband for over 30 years (never legally separated or divorced). Apparently now he has come into a lot of money and he wants a divorce. He has never paid one cent in child support of their 2 children. Is there any legal way she can collect on unpaid child support. She has paper saying that he should pay child support (back 30 years ago). I would appreciate any help in what she would need to do. Does she have any legal rights? Thank you very much for any advice you can give me.

Without seeing the "paper" it's hard to tell. She should consult a local attorney and discuss the situation in detail.
In the event the paper that you refer to is a court child support order, she would indeed be entitled to back child support. The fact that her husband wants a divorce may actually help matters. Please have your sister contact me to schedule a no-fee initial consultation. I may be reached at (212) 786-7539.
