I am divorced 10 years, my ex husband and I would like to re write our own agreement regarding child support and visitation, what would I have to do to make it a legal and binding agreement?

Re: A written agreement?

Hire someone like me who can take the

prior Agreement and a list of the changes

you want, draft a Modification Agreement

and arrange for its execution and proper

filing, and probably not charge more than

$ 200 to $ 300

I would suggest that you contact an attorney. Not only does the agreement need be amended, but a new support order must be entered in court. divorce.

Re: A written agreement?

First, it depends if the non-custodial parent is making payment to the Child Support Collection Unit. If yes, I would proceed to family court on a petition for modification of child support. You do not need an attorney, just go to the "intake room". The stipulation is put on the record before a Judicial Hearing Officer and child support would be "legally" modified.

If child support payments are being made directly to the custodial parent, just write an agreement modifying the prior support award. The agreement must be signed by both parties and both parties should have an original.

Mike.
