Legal Question in Family Law in New York

it has been over two years i am sepperated, she still lives in the home with her boyfriend and i i have had my boys living with me.how can i get my half of the property vallue. does she have to sell it?

Is there a separation agreement? If so, what does it say about the sale of the property?

If you don't have a separation agreement, you can finally obtain a formal legal separation or you can file for divorce. Obviously, you have grounds based upon adultery. In the divorce pleading, you can request a sale of the property and division of the proceeds. In addition, if you want the child custody status to remain the same, you may also be entitled to child support.
