Legal Question in Family Law in New York

After more than eight years I submitted a form to the NYC child support offices to have a COLA increase. I feel this was a mistake because now I have a sent notification to appear in court and submit proof of income and assets. It should be noted that during the eight years the non custodial father only paid about $2500 in support and never had any contact with the child. Because of the length in time I do not wish the father to have any contact or knowledge of my or the child's whereabouts. I would rather not have the increase than show up at the hearing. My question is, "What would the penalty be for not showing up" and if I do show is it possible to not allow the non custodial father any information with regard to where we live - which is no longer in NYC. It should also be noted that the non custodial father has never petitioned for visitation or showed any concern regarding her whereabouts.

A. Yes. However, you would have to receive permission from the Court.
