What is the New York Child law?

my husband and i are both in the military and were married here in new york. our daughter was born in new york. we are getting a divorce and my husband is getting out of the military and going back to texas where my husband and i are from. since our divorce hasn't even started yet, can he take my daughter from me?

If what you are asking is whether he can take your child to Texas, the answer depends on several factors. One if she has been a resident of NY for more than six months then she is considered a resident and thus NY would have jurisdiction to hear a custody petition. If that is the case, then they will consider the "best interest of the child" to determine who should have custody. If that is a probability then you should speak to an experienced attorney.
