Legal Question in Family Law in New York

New York Child Suport

I have a order ''on consent'' child support issued thru NY Fam. Court dated 2004. My son's father as of date, has never sent any monies. I now want to have the money collected thru Support Collection Unit. My question is, can I collect monies that were never paid from 2004 to present and will a new calcuation be made based on my financial sistuation at present?

Re: New York Child Suport

Not only can you request the assistance of SCU, but you can file a violation/enforcement petition which may provide several methods for you to collect unpaid support arrears. You are entitled to whatever amount is in the order from the time it was entered until such time as it is modified or terminated; if the father petitions successfully for modification, it will only be effective from the date of filing. Consult an attorney to discuss your case in detail for a better understanding of your options.
