Legal Question in Family Law in New York

New York divorce - 1-year seperation agreement ground

By jointly signing the 1-year

seperation agreement, am I legally

not responsible for financial liabilities

that my spouse could incur during

that year (eg, credit cards, taxes,

etc)? Also, if I file under

Abandonement and then wish to

switch it over to 1-year seperation

agreement...is that possible? I live in

NYC and my spouse in California.

A properly drafted separation agreement will contain language handling debts, including those in the waiting period.

On switching grounds during the process - that's something that can often be done. However, it's easy to avoid the problem through proper drafting of the complaint.
