Legal Question in Family Law in New York
In New York. My son is 12 yrs. old. When I went to court to seek a modification of child support they adjourned it to a later date. It got so ugly that I said I no longer wanted the money but the Judge would not allow it. Afterwards the father threatened that if I didn't hold to what I said in court which was that I "didn't want the money" he would file charges against me with CPS claiming I was unfit and mentally unstable. Even though I agreed to drop the claims for child support he went to CPS anyway. He is cunning and is able to claim victimhood so I am afraid of how believable he will come across. I am afraid of losing my job and of losing custody. I have recents texts from him which claim that he never wanted me to have my son and does not want to take any responsibility. I'm afraid that with an open case they will not grant me sole custody even though the father claims he doesn't want custody. He is being hateful and doesn't care if our son is placed in foster care, even though he has established a relationship with him through the years. Advice is appreciated.
