Under New York State law, if either husband or wife sues the other for palimony or alimony, how much can the courts order the respondent to pay? Can either partner take as much as 50% of your working income or retired income? [email protected]

Under NYS law, in the context of a divorce action one spouse could demand "Spousal Maintenance" from the other. The analysis is not based upon percentage of income, like child support is. The court will take into account factors such as length of marriage, work history of parties during marriage, standard of living of both parties during the marriage, etc.
