Legal Question in Medical Leave in New York
equivalent pay
In February of last year (99-00 school year) I took a 4 month maternity leave from my position as a school teacher. I did not request FMLA leave becasue I was unaware of the FMLA leave act since my employer never posted any notices. Upon return to work this September, my salary has been lowered by $600 because of my leave. My employer says that he has a right to do this because I did not work a full year in 99-00 and therefore am not eligible for all of the previous year's (98-99) raise. Others who take unpaid leaves for portions of the year are subject to the same salary decrease. Is this legal for a maternity leave?
