Legal Question in Medical Leave in New York
Maternity leave
I left my job in august of this year on maternity leave. It is now time for me to return to work. I went to the office and had a meeting with my employer. They advised me that they would take me back to my original position with a $10,000 a year pay cut. Can they so this?

Re: Maternity leave
Assuming you and your employer meet the applicable FMLA guidelines and requirements, they absolutely CANNOT do this. This is a clear example of retaliation and discrimination. If they put their pay reduction request in writing, the odds are stacked very high in your favor.
You can contact my office via email or through FMLA-Attorney.com for more information. In any event, I urge you to seek counsel before having further communication with your employer.
I look forward to assisting you.
