Legal Question in Medical Leave in New York

I am a teacher in New York state when I take a day off my boss put me in for fmla plus takes a sick day away from me. can they do that?

The FMLA was meant to be a negotiated leave at the request of the employee and it can not be forced on an unwilling employee that has not exhausted employer provided sick time.
