Legal Question in Medical Leave in New York

I work out of a home office in NY as a full time auditor (on salary). The home office is in Manhatten and has more that 50+ employees. I have been told that I would not be entiltled to family leave as we do not have 50+ auditors in NYS.

I am taking care of my elderly mother and at some time can envison a situation where I could use the FLA. The company says I am not eligable. Is this correct.
