Legal Question in Civil Litigation in New York
Attorney's Fees
Hi! I'm an admitted attorney, although I do not really practice. I work for a construction company and I am about to sue for unpaid invoices in small claims court. The defendant customer has a credit agreement with us, stating that in the event of default, he will be responsible for 1 1/2% per month interest on the unpaid amount. In addition, the credit agreement states that they are to be resposible for the greater of either actual attorney's fees incurred or 25% of the balance.
My question is: How are these fees calculated? Thanks very much for your help!

Re: Attorney's Fees
Since you are a salaried employee your company is not incurring attorney fees.
