Legal Question in Civil Litigation in New York
auto accident
I was in a auto accident, the other vehicle crossed the double lines and crashed into the side of my vehicle causing me to go off the road. They claimed they had an emergency and had to leave giving me all of their info. I called the police and made my report the other driver had also made a report, but now stating I lost control of my vehicle and crossed the line causing the accident. I have pictures of the site showing where my vehicle was knocked off the road, and looking at the vehicle you can tell what happened. he has damage on the front driver side of his vehicle and my damage is on the driver side in the center of my doors and rear quarter panel, the accident was at a shape bend in the road. his insurance company is tring to offer me 50% settlement on the damages to my vehicle being the police report was not taking at the scene and the officer could not assign blame. After it is all said and done it will be about 6500.00 in damage. I am self employed and my vehicle is about 50% of my business. I need HELP any advice on how I should proceed?

If they don't offer you more, turn it down and sue.
Its tough luck but its real life; this is what comprehensive is for.
The insurance company will still have to defend the case, and will either settle it, or take it to trial, but if you sue in day court, district court, you can go up to the value of most cars without difficulty. Any witnesses?
