Legal Question in Civil Litigation in New York

In the beginning of 2009 I was added to a lawsuit, my attorney said he answered and I had not heard back I was never served in 2009. A few weeks ago April 2012 a process server came to my home and served the papers on my sister since I wasn't home. The suit is the same one from 2009. My new attorney said in 2009 they never served me for whatever reason. Is there a statute of limitations on when i'm supposed to be served? Thanks
