Legal Question in Civil Litigation in New York

I bought a car from a guy on craigslist.com and he told me he didnt have the title on him but would get it in a couple of days. We agreed I would pay half then and the rest when I recieved the title. It's been 2 months and still no title. I have the original craigslist post and a ton of texts between him and I. What can I do?

Write a final demand letter and then sue.

You can sue to force him to turn over the title (assuming he is the owner and the title isn't encumbered) or the return of your deposit plus damages for the breach of contract.
