Legal Question in Civil Litigation in New York
My brother died tragically in a car accident. His ex-girlfriend has some of his belongings and his children want them back. she is not being cooperative in returning them. What can we do.

The executor wll have to sue for his belongings. If nobody has opened a matter in probate court, you may want to petition to court for an appointment. At that point, you will have the responsiblity to collect his assets, pay his liabilities from those assets, and bring suit on behalf of the estate.
