Legal Question in Civil Litigation in New York

for the second time-someone sent bullets into our home. the NYPD has been informed and even sent detectives to our home on 7/16/03. We live on a nice block across the street from the Mariners Harbor Housing Projects and for a long time we didn't hear any 'gun' play from that area, but recently it has startered again. Can the law protect us if we sue the city for neglegence since we happen to know that after 24:00 there aren't any 'street crime' units or otherwise around our neighborhood (we were informed of this by a member of the NYPD). Could we find an attorney who would take such a case under 'pro-bono'? (hope I spelled it correctly). This is very upsetting to us since we have spent alot of money upgrading our home and just recently refinanced. We never thought that this could or would happen. Your input would be greatly appreciated.

You are right - this is awful. And you have a right to police protection. Unfortunately, this is not a legal question. This is a political question. How the police department uses its resources is something that courts and lawyers cannot help you with. But this is the job of your elected representative and they all have people in their offices who are getting paid with your tax dollars to help you with this exact problem. USE THEM. You have paid for them. City council, state legislator, even your congressman. They can and will help you with this problem. Unless you can prove it was an officer firing the bullets a lawsuit against the city would likely be unsuccessful.
