Legal Question in Civil Litigation in New York

civil suit against principal?

My son has been harassed all year by

his middle school principal, who

considers him disrespectful and says

that he doesn't show ''proper

humility'' towards adults. He has

suspended my son in-school 7 times

so far this year for infractions that

would normally get a warning or at

most a detention. In a study hall

another student gave my son pills

which he told my son were aspirin.

They turned out to be prescription

pills this boy took from his mother.

The other boy admits giving my son

the pills, but claims he did so outside

of school. The principal did nothing

to this admitted distributor of drugs,

but suspended my son out of school

for 5 days and then successfully

sought a ten week suspension from

the superintendent. The district has

stifled our appeals at every turn, and

I'm wondering if we can sue the

principal personally for defamation,

malicious prosecution, etc.

No you wouldn't be successful. You need to contact an education law litigator. This is a subspecialty of civil litigation that very few people know about.
