Legal Question in Civil Litigation in New York
My claims were denied
My car wa parked on the street legally. A truck was pulling out of a construction site on the same block, got caught on telephone wires which in turn, made the verizon telephone pole, fall over on top of my car. So there is extensive damage to the hood and roof. So, I filed a claim first with the truck company. They denied me because they said in that particular area, telephone wires should be 15 high. They said that because their trucks are only 136 high, they couldnt have caught the wire if it was at 15 so they put the blame on verizon, saying that their wires were too low. So, I filed a claim with verizon. Just got denied by them. They said that if the truck pulled into the site successfully, they cant say that the wires must have been low. Also, she said something about verizon never receiving notice about the low wires and in the state of NY you need notice to be liable. This was her spiel.
In the meantime, I don't have collision coverage so the car has been sitting at the mechanics shop for a month. The damage is about $1500-$2000. It's not that I can't afford to pay it, it's the principal. What should I do?

Start a lawsuit against both parties. Let them sort it out in court.
