Legal Question in Civil Litigation in New York
Collecting a judgement
I was told the the individual that brings a small claims case to court is responsible for collecting the judgement if it's decided in their favor. If so what is to prevent the loser of the case of simply refusing to satisfy the judgement? They could simply claim that they are destitute and as such are incapable of paying. Please let me know at your earliest convenience and thank you for your time.

You file a judgment...it is good for 20 years. You can attempt to find a bank account and have the sheriff or marshall levy against it.
