Legal Question in Civil Litigation in New York

contingency fees

Are New York attorneys allow to charge for briefs & filing fees, when there is a contract under contingency already? Isn't this paying twice?

Re: contingency fees

I'm not sure what you mean by "briefs." Filing fees are a cost imposed by the court for litigation, they are not charges from your attorney and they are part of the cost of litigation. Such fees are reimbursable for the attorney and deducted from a contingency fee settlement at the end.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699

Re: contingency fees

Suggest you read your retainer agreement. Usually, court expenses are advanced by the attorney but reimbursed before the attorney takes his fee at the time of recovery.

Usually, there is no extra charge for court briefs.

Re: contingency fees

Read your retainer agreement. Appeals may be extra ,,as may be something that you want your attorney to do that he suggests is not fruitful.

Good Luck
