Legal Question in Civil Litigation in New York
My ex-girlfriend when we were still together took out a line of credit from capital one without my knowledge for $15,000. She sign my name on the contract and used my SS# to open the account. When I found out about a few months later I started to pay it because I did not want my credit to be ruined. At the time we had a joint checking account but i was the only one working. The account is now closed and we are no longer together. I wanted to know if i can sue her for fraud and some how have her pay me back the money.

It appears that you may have ratified your girlfriend's use of your credit by making payments and not reporting her illegal access to your account. You may, however, file suit against her on the grounds that you gave her a personal loan and she has refused to make payments if you actually demanded payment and she refuses to make payments.
