Legal Question in Civil Litigation in New York

Furniture purchased on credit for son's girlfriend

I purchased some furniture with a deferred billing option for my son's girlfriend, relying on a verbal agreement that she would pay me once the billing statements became active. It's been a few months and she has refused to pay me the minimum payment for any of the billing statements that I have received. Is this a case that I can have resolved in a small claims court? Also, do I have a good likelihood of winning with only our verbal agreement to defend my side?

Re: Furniture purchased on credit for son's girlfriend

Verbal contracts are enforceable. However, a verbal agreement to assume the debt for another may violate the Statute of Frauds. The fact that she has the furniture works in your favor.

Small claims court is a good option. You may be able to settle the dispute with the help of the arbitrator.
