Legal Question in Civil Litigation in New York

My girlfriend registered with payless shoe store to receive offers and coupons, the sales clerk used the information she entered to text her and try to flirt with her. He has access to our home information and we are not comfortable with an employee inappropriately using our info. Is there any legal action we can take against the sales clerk or payless for not protecting our info. We do not feel safe because the store is located in our neighborhood.
