Legal Question in Civil Litigation in New York

Hi,

I have a tree in my yard that overhangs neighbors property. The tree is solid and without disease. It's only issue is that it is not growing at 90* but I would estimate somewhere between 75-80*. Is this enough to constitute a hazard where I would be liable for any damage were the tree to fall during a storm or otherwise? I live in New York.
