Legal Question in Civil Litigation in New York

housing cooperative corp v. shareholder

Is there any NYS law that prohibits the open and public discussion of pending litigation by parties or non parties, or is it up to a judge to issue this type of ''gag order'' in the prevention of the discussion of a lawsuite. I was under the impression that civil litigation in NYS was public information and available to anyone who goes to the court and pays a fee to obtain copies of the documents filed in court. Thanks

In almost all cases documents files with the court are public records, available for copying. There are some exceptions, and some information, such as social security numbers, is to be redacted before copying (or, in some cases, filing).

Discussion is another matter. There are limits on what attorneys can say about pending litigation. Parties are generally not subject to similar legal limitations, unless the judge has for some reason issued an order to which they are subject.
